General information
1.1. These Terms of Sale apply to any Coupon purchased from Betconfigurator.com.
1.2. Betconfigurator.com means Multinovum Sp. z o.o., ul. Kolberga 16c / 30, 81-881 Sopot, KRS 0000634307, NIP 5851475378, Regon 36527870600000.
1.3. Coupon means an instrument, whether in physical or electronic form, that entitles the Coupon holder (hereinafter referred to as "Coupon Holder") to: receive an offer with information on betting setup (collectively "Coupons").
1.4. Partner's Offer means Coupons delivered to the Coupon Holder by the Partner, in accordance with the terms and conditions made available on the Betconfigurator.com Portal and on the Coupon.
1.5. The Affiliate is a third party unrelated to Betconfigurator.com that sells or delivers the Affiliate's Offer. Betconfigurator.com sells Coupons from the Partner's Offer. Betconfigurator.com only sells and delivers Coupons.
1.6. These Terms of Sale were last updated on 02/01/2022. Betconfigurator.com reserves the right to unilaterally amend these Terms of Sale at any time. Any changes to these Terms of Sale will be published online. The only valid version for the User is the version of the Terms of Sale that the User agreed to when purchasing the Coupon.
Purchase of the Coupon
2.1. The coupon can only be purchased by people over 18 years of age. Before making a purchase, you must register and create an account on the Betconfigurator.com Portal.
2.2. Clicking the button "OK, paying online" will send an offer to purchase the Coupon to Betconfigurator.com. However, the transaction will be successfully completed only upon receipt of an e-mail from Betconfigurator.com confirming the acceptance of the User's offer. Betconfigurator.com expressly reserves the right to decline the User's offer. In addition, even if Betconfigurator.com has accepted the offer, it may withdraw from the contract at any time if it is reasonably suspected that the User has committed or may be committing fraud against Betconfigurator.com, a third party affiliated with Betconfigurator.com or against the Affiliate.
2.3. The Affiliate may use its own terms of sale, delivery or the terms of delivery of the Affiliate's Offers.
Coupon Redemption
3.1. Unless explicitly stated otherwise:
(a) The Coupon can be redeemed any number of times, at different betting companies (please note that in other betting companies than the one indicated on the Coupon, the offer may differ);
(b) The Coupon can only be redeemed at the betting company and not at the premises of Betconfigurator.com;
(c) The Coupon is valid for one person only; and
(d) you must follow the instructions relating to the Coupon when redeeming the Coupon.
3.2. All Coupons sold by Betconfigurator.com can be redeemed at different betting companies, however please note that at other betting companies than the one shown on the Coupon, the offer may differ. Please also note that from the moment a Coupon is created until a bet is placed, the offer may change. Betconfigurator.com is not responsible for these changes and cannot bear any consequences thereof.
3.3. In order to redeem the Coupon, you must enter the coupon data on the website or in a stationary facility offering mutual wagering. A Coupon not redeemed within the Term (beginning of the first Coupon event) of redemption automatically expires. An expired Coupon cannot be redeemed and the Coupon Holder is not entitled to a refund or compensation.
3.4. Unless expressly stated otherwise, a Coupon entitles the Coupon Holder to receive a betting offer immediately after purchase.
3.6. Coupons can be redeemed in full or in part. The Coupon Holder decides which data from the Coupon will be used when placing the bet.
3.7. If, due to unforeseen circumstances, the Affiliate is unable to deliver the Affiliate's Offer as described, Betconfigurator.com will immediately notify you by e-mail. Betconfigurator.com will offer you a new coupon with comparable benefits (if such a coupon is available) or a refund of the Coupon price.
Coupon Use
4.1. The coupon can only be purchased for personal, non-commercial use.
4.2. You are solely responsible for the Coupon. Neither Betconfigurator.com nor the Affiliate are responsible for lost or stolen Coupons or for the retrieval of offer numbers or security codes.
4.3. You undertake not to provide false information, including false names, address or contact details, or payment details; You also undertake not to take any unlawful actions regarding the purchase or use of the Coupon, as well as not to allow such actions by other persons.
4.4. Any attempt to redeem a Coupon contrary to the Terms of Sale may result in the Coupon being invalidated at Betconfigurator.com's sole discretion.
4.5. It is forbidden to duplicate the Coupons.
4.6. Professional trading with Coupons is prohibited.
Cancellations (and Exceptions), Refunds, and Issues
5.1. Due to the fact that after purchasing and paying for the Coupon, you will receive data enabling the use of the information contained in the Coupon, you have no statutory right to withdraw from the contract for the purchase of the Coupon. For the avoidance of doubt, this point applies to all offers while placing an order.
Responsibility for the Partner's Offer
6.1. Please note that the Affiliate, and not Betconfigurator.com, is the person who configures the content of the Coupon.
Standards of service and liability of Betconfigurator.com
7.1. Betconfigurator.com declares that:
7.1.1. will make every effort to perform its obligations under these Terms of Sale;
7.1.2. Coupons are of satisfactory quality and useful for the purpose for which they were created; and
7.1.3. will not breach the requirements of honesty and professional diligence in the scope of the services it provides.
7.2. Betconfigurator.com is always responsible for: (a) death or personal injury caused by its negligence / gross negligence; (b) fraud or willful misrepresentation by Betconfigurator.com; or (c) any failure to comply with any obligation set out in clause 7.1. above or implied contractual terms that may not be excluded or limited under applicable law.
7.3. Except as provided in item 7.2. Betconfigurator.com shall not be liable in any way for damages not caused by default or other losses or damages suffered, including indirect losses.
7.4. Betconfigurator.com does not guarantee the completeness, usefulness or legality of the Partner's Offer. Betconfigurator.com is not responsible for the quality, safety, usability or other features of the items included in the Partner's Offer.
7.5. Betconfigurator.com shall not be liable for any breach of an obligation under these Terms of Sale if the fulfillment of a given obligation has been made impossible or difficult for reasons beyond its control.
7.6. Except for the liability under clause 7.2, which is unlimited, Betconfigurator.com's total liability to you will not, under any circumstances, exceed 100% of the Coupon price.
7.7. Some countries' laws do not allow you to make some or all of the exclusions or limitations set out in section 7. If you are subject to such laws, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights.
Betconfigurator.com portal
8.1. Betconfigurator.com Portal (hereinafter the "Portal") means a website, mobile applications, electronic means of communication or services, or any location where a Coupon from Betconfigurator.com can be purchased. The portal on which Betconfigurator.com offers Coupons is the property of Multinovum Spółka z o.o. More information on the Betconfigurator.com Terms of Use, which are expressly incorporated into these Terms of Sale.
Miscellaneous
9.1. If you breach these Terms of Sale and Betconfigurator.com does not take any action against you, this does not mean that Betconfigurator.com waives any rights and remedies related to the breach. Betconfigurator.com retains the right to take action or exercise any rights or remedies in respect of a given breach or in connection with any breach of obligations under these Terms of Sale.
9.2. Unless expressly provided for in these Terms of Sale, any representations between the parties must be made in writing and delivered by email (except for the statement sent to Betconfigurator.com in connection with taking legal action) or postage paid by the sender. Betconfigurator.com will send all statements to the address provided when registering your Betconfigurator.com account. All statements made to Betconfigurator.com may be sent to the registered office address specified in section 1.2.
9.3. Should any provision of these Terms of Sale be held invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. The provisions of these Terms of Sale, which have been found invalid or unenforceable, will be replaced by such valid and enforceable provisions that will ensure the achievement of an economic result closest to that envisaged by the provisions considered invalid or unenforceable.
9.4. These Terms of Sale are subject to the provisions of the law in force in Poland and should be interpreted in accordance with them, excluding the provisions of private international law. All disputes will be subject to the exclusive jurisdiction of the competent courts in Poland.
